Terms and Conditions

In the unlikely event that you do need to return goods to us, please help speed up the procedure by following our guidelines.

You need to return the goods to us before we can replace them or reimburse you. Please contact us by emailing info@thechiashop.com or call 01363 772695 before returning items.

DAMAGED / FAULTY GOODS

You should inspect the goods when you receive them for damage or defects. In the event that your order is incorrectly shipped or found to be damaged or defective, please contact us within 7 working days of receipt of goods. Any returned goods should be promptly sent back to the address on the packing slip in its original packaging and in the condition that it was received. We will then offer you a full refund or replacement including postage. Under no circumstances must items be continued to be used when damaged, as this could be dangerous and you will have been deemed to have accepted the goods in their damaged condition.

RETURNS

You can claim a full refund or exchange on any item purchased from our on-line web shop if it is returned in good condition and in its original packaging within 14 days.

Refunds and exchanges may only be processed when the returned items have been received by The Chia Shop. We recommend you obtain a certificate of posting from the Post Office and consider insuring your parcel in order that you can claim for any loss or damage, as we are unable to compensate for parcels that are damaged or mislaid in transit. Please ensure that all items returned are appropriately packaged to prevent damage in transit. Refunds will be made directly to the person/company that originally paid for the goods, either by cheque or by credit card according to the original payment method. Please note that Postage and Packing will only be refunded for faulty/damaged or incorrectly supplied item.

PRIVACY NOTICE

Privacy Policy We are committed to protecting your privacy. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998. We collect information about you for 2 reasons firstly, to process your order and second, to provide you with the best possible service as this information will be passed to our nominated delivery company to enable them to deliver your order.
We will not email you in the future unless you have given us your consent.

This information is stored in a password protected database operated by The Chia Shop.

Your credit/debit card details are collected by Paypal and not held or accessible by us. This information is transmitted via Paypals industry standard encryption SSL secure server.

The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.

The personal information which we hold will be held securely in accordance with our internal security policy and the law.

If we intend to transfer your information outside the European Economic Area we will always obtain your consent first.

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a cookie which would be stored on your browser - this is also used to track the contents of your shopping cart whilst on our site. CONDITIONS OF USE

We will not pass your details on to any third parties. All transactions are handled using secure servers. Credit card processing is processed by Paypal and your card details are not kept by The Chia Shop.
Below are the terms and conditions which, along with the web site terms and conditions, govern orders by you ("you") of [The Chia Shop] "the Products" through this web site. By ordering the Products you are acknowledging that you understand and agree to be bound by the terms and conditions set out below.
General Information
1. Details of the amount, type and price of Products ordered by you [along with any applicable delivery costs] are set out in the order form which you submit to us via this web site. The price of each Product stated on the order form is only valid for as long as such price is stated on the order form.

Payment
2. You must pay for the Products by credit card,via PayPal. We cannot accept responsibilty for any items lost in the post to our address. If paying by credit card, your card details will be requested after you submit the order form. You must enter your credit card details on the secure site. [All card details are encrypted at the highest level available for commercial use.] If a third party makes dishonest or fraudulent use of your payment card for any form of home shopping you have certain rights under the Consumer Protection (Distance Selling) Regulations 2000 to cancel the payment and obtain a refund from your card issuer. Delivery
3. The Products will be delivered to the address submitted by you as the address for delivery on the order form (or, if no such address is submitted, the address of the cardholder) within [30] days of the day on which you submit the order for such Products to us, but usually within 7 working days. As soon as the Products have been delivered to you, you will be responsible for them. You will only own the Products once we have been paid in full in respect of such Products.

If we are unable to procure that the Products are delivered to you within the time period as set out above, we will inform you of this and either reimburse any sums paid by you in relation to such Products within 30 days of the day on which we should have delivered the Products to you or, with your agreement, procure that the Products are delivered to you by another date.

6. You have the right to cancel your order at any time before your goods are dispatched. We will refund the full amount less debit/credit card surcharges.

Statutory Rights
7. These terms and conditions do not affect your statutory rights.

8. This website is subject to the law of England and Wales and any disputes will be dealt with by the Courts of England and Wales. If ordering outside of England and Wales it is your responsibility to check with your local laws as to the legality of our products.

The Chia Shop shall not have any liability whatsoever or be deemed to be in default for any delays or failure in performance under these Terms and Conditions resulting from acts beyond its control, including by not limited to acts of God, acts or regulations of any governmental or supranational authority, war or national emergency, terrorist activities, accident or fire.

10. It is the customers responsibility regarding import and customs regulations for their own locality.We do not assume liability of any kind for shipments seized by customs.
